MDR Definition
A Manifestation Determination Review takes place within 10 days of the decision-making process to decide if a student’s school placement has to change due to violating a student code of conduct. The meeting can be recorded. The school staff and parents determine whether or not a) the student’s conduct was a result of the child’s disability and b) if the conduct was due to a failure on the school’s part to implement the student’s IEP.

Full Summary
An 11th grader with autism is going to be suspended from Lemon High School for 45 days due to a physical attack on a 9th grader 7 days ago. The incident occurred in one of the school’s restrooms. One of the janitors witnessed the incident and immediately called the school police. The student will be temporarily placed at an alternative school, Oportunidad High School, for 45 days. She will meet with a school psychologist to work on life skills (videos on appropriate behavior), continue with her speech therapy, and take homework from Lemon High School to complete at this temporary placement school.
Main Challenges
The mother does not speak any English and the father is able to communicate effectively in English. They are both at the meeting. The cosmetology teacher speaks Spanish and speaks in Spanish directly to the parents without giving the interpreter the time to interpret into English.
